Terms and conditions

Last updated: 7 October 2026

These terms and conditions ("Terms") apply to all services provided through dpp24.org.

The service provider is:

Mag. Werner Braun
Rudolfstrasse 231
8047 Graz
Austria
Email: office@dpp24.org

"We" and "us" refer to the service provider. "Customer" refers to the business that uses our services.

1. Scope, business customers only

1.1 Our services are offered exclusively to businesses (entrepreneurs within the meaning of § 1 of the Austrian Consumer Protection Act, KSchG), public bodies and other organisations acting in the course of their commercial or professional activity. They are not offered to consumers. By registering or ordering, the customer confirms that it acts for business purposes. The person registering confirms that they are authorised to act for the customer.

1.2 These Terms apply exclusively. The customer's own terms and conditions do not apply, even if we do not object to them, unless we have expressly agreed to them in writing.

1.3 Individual agreements (for example an Enterprise offer) take precedence over these Terms.

2. Services

2.1 We provide:

  • a free tool for generating static QR codes in the browser;
  • dynamic QR codes ("forwards") under addresses such as dpp24.org/ABC/01/7, whose destination the customer can change at any time;
  • hosting of Digital Product Passport documents provided by the customer ("Hosted DPP") on passport pages under dpp24.org/info;
  • related functions such as QR sets, CSV import, bulk downloads, change history and member access.

2.2 The features, limits and prices of each plan are described on our pricing page as valid when the plan is ordered, or in an individual offer.

2.3 The free QR tool is provided as is, without any warranty. Static QR codes contain their destination directly and cannot be changed or switched off by us.

3. Contract, account and prefix

3.1 The contract for the Free plan is concluded when the customer creates a workspace. A contract for a paid plan is concluded when we confirm the customer's plan request by email or activate the plan in the workspace. We may decline a registration or request without giving reasons.

3.2 The customer must provide accurate information, keep it current and keep access credentials confidential. The customer is responsible for all actions performed through its accounts and must inform us without undue delay of any unauthorised access.

3.3 Each customer reserves a three-letter prefix. Prefixes are assigned on a first-come basis. Because printed codes depend on it, a prefix cannot be changed. We may withdraw a prefix that obviously infringes third-party rights or is misleading.

4. Plans, limits and trial

4.1 Each plan includes a maximum number of forwards, hosted passports and members. A forward is a code that is in use, either because it has a destination or because it has a hosted passport. A hosted passport is a code with a published passport document.

4.2 When a limit is reached, no further forwards or passports can be added until the customer moves to a larger plan or removes entries. Existing codes are never switched off because a limit is reached.

4.3 Free plan. The Free plan is limited to six months from registration. After that, the workspace becomes read-only and the customer can move to a paid plan. Codes created in the Free plan keep forwarding for 30 more days and then lead to a neutral information page (section 8.3). We may change or discontinue the Free plan at any time.

4.4 Trial. A customer can test the Passport plan once for 30 days free of charge. The trial ends automatically and does not turn into a paid plan. After the trial, the previous plan applies again. Content added during the trial stays available but counts towards the limits of that plan.

4.5 The customer can move to a larger plan at any time. A move to a smaller plan takes effect at the end of the current billing period, provided the usage fits the smaller plan.

5. Prices, invoicing and payment

5.1 All prices are in euros and exclusive of VAT and other taxes. For customers in other EU member states with a valid VAT identification number, the reverse-charge procedure applies. Customers outside the EU are responsible for any taxes, duties and withholding taxes in their country. If a withholding tax applies, the customer pays the amount needed for us to receive the full invoiced amount.

5.2 Paid plans are invoiced in advance for the chosen billing period (monthly or yearly). Invoices are sent by email and are due within 14 days of the invoice date without deduction.

5.3 In case of late payment, statutory default interest for business transactions applies (§ 456 UGB). We may also charge reasonable reminder costs.

5.4 If an invoice remains unpaid 14 days after a written reminder, we may restrict the workspace to read-only. Printed codes and published passports keep working during this time. If the amount is still unpaid 30 days after the restriction, we may terminate the contract for cause; section 8 then applies.

5.5 We may change prices with effect from the next billing period. We will announce price increases at least six weeks in advance by email. The customer may then cancel the plan with effect from the date the new price applies.

6. Term and cancellation

6.1 Paid plans run for the chosen billing period and renew automatically for the same period unless cancelled.

6.2 The customer can cancel at any time in the workspace (Plan & usage) or by email, with effect from the end of the current billing period. Fees already paid are not refunded, except in the case of section 5.5 or where required by law.

6.3 Either party may terminate for cause with immediate effect, in particular if the other party materially breaches these Terms and does not remedy the breach within a reasonable period after written notice, or in the cases of sections 5.4 and 9.4.

7. Customer content and Hosted DPP

7.1 The customer is solely responsible for all content it provides or links to through our services, including destination addresses, product names, passport documents and any other files ("Customer Content"). This includes responsibility for its accuracy, completeness, timeliness and legal compliance, and for ensuring that it does not infringe third-party rights.

7.2 We do not review Customer Content before publication. We store and display it on behalf of the customer as a hosting service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (Digital Services Act) and § 16 ECG.

7.3 The customer grants us a non-exclusive, worldwide right, limited to the term of the contract including any archive period, to store, copy, display and make Customer Content available to the extent necessary to provide the services.

7.4 Anyone can report unlawful content to office@dpp24.org. We will examine reports promptly and may block access to content where there are reasonable grounds to believe it is unlawful or violates these Terms. Where possible, we will inform the customer and give reasons.

7.5 If Customer Content contains personal data, our data processing agreement applies and forms part of the contract.

8. After the end of a plan: archive mode

8.1 Printed codes should not break. After a paid plan ends, the workspace becomes read-only and the customer's dynamic codes keep forwarding to their last destination for 12 months ("archive mode"). Published passports stay online and unchanged during this time.

8.2 Archive mode can be extended after these 12 months, in each case for one year, for the archive fee shown on the pricing page (currently EUR 49 net per year), up to the limits of the last plan.

8.3 When archive mode ends, the customer's codes and passport pages lead to a neutral page on dpp24.org, which states that the product information has moved and names the customer. No advertising is shown on it. The customer's prefix stays reserved for the customer and is not given to anyone else.

8.4 Before the end of the contract or of archive mode, the customer is responsible for downloading and keeping any information it is required to retain, in particular passport documents that must stay available for a legally required period. Customer Content is deleted 90 days after archive mode ends, unless we are legally required to keep it.

8.5 Customers using our services for legally required product information must themselves ensure that their chosen plan and archive period meet any legally required availability or retention period.

9. Customer obligations and prohibited use

9.1 The services may not be used for phishing, malware, fraud, deceptive or unlawful content, infringement of intellectual-property rights, unauthorised tracking or surveillance, distribution of illegal material, or any other activity that violates applicable law or third-party rights.

9.2 The customer must not attempt to circumvent technical limits or security measures, place unreasonable load on the service, or access other customers' data.

9.3 The customer confirms that neither it nor its owners are subject to EU, UN, US or other applicable sanctions, and that it will not use the services in violation of export control or sanctions laws.

9.4 We may suspend individual codes, passport pages or accounts if there are reasonable grounds to believe that they are being used unlawfully, maliciously or in breach of these Terms. Where possible, we will inform the customer first.

10. Digital Product Passports and regulatory information

10.1 We provide technical infrastructure and general information. Our services are not certification, conformity assessment, legal or regulatory advice, or an official confirmation of compliance with Regulation (EU) 2024/3110, the Construction Products Regulation or any other product legislation.

10.2 We do not act as a notified body, certification body, market surveillance authority, authorised representative or economic operator for the customer's products, unless expressly agreed in writing.

10.3 The customer remains responsible for determining which requirements apply to its products and for meeting them, including the content, format and data carrier of any Digital Product Passport.

11. Availability and support

11.1 We use reasonable efforts to keep the services available and secure. Uninterrupted or error-free availability is not owed unless a service level agreement has been agreed in writing (Enterprise).

11.2 Interruptions may occur in particular due to maintenance, updates, failures of networks or of our hosting provider, security incidents or force majeure. We will announce planned maintenance in advance where possible.

11.3 Support is provided by email as described for each plan on the pricing page.

12. Changes to the services and these Terms

12.1 We may develop and change the services, provided that the main features of the customer's paid plan are not substantially reduced.

12.2 We will notify customers of changes to these Terms by email at least six weeks before they take effect. If the customer does not object before that date, the changed Terms apply; we will point this out in the notification. If the customer objects, either party may terminate the contract with effect from the date the changes would take effect.

13. Warranty

13.1 We will remedy reproducible defects of the services within a reasonable time after the customer reports them in sufficient detail.

13.2 The customer must report defects without undue delay after discovering them.

14. Liability

14.1 We are liable without limitation for damage caused intentionally, for personal injury, and wherever liability cannot be limited by law, in particular under the Austrian Product Liability Act.

14.2 Liability for slight negligence is excluded.

14.3 In cases of gross negligence, our liability is limited to the foreseeable damage typical for this type of contract and, per year, to the total fees paid by the customer in the twelve months before the damaging event, but at least EUR 1,000. Liability for loss of profit, indirect and consequential damage, and loss of data is excluded in cases of gross negligence, to the extent permitted by law.

14.4 We are in particular not liable for damage resulting from Customer Content, destination addresses chosen by the customer, websites of third parties, the regulatory non-compliance of the customer's products, or use of the services contrary to these Terms.

14.5 Claims for damages must be asserted in court within one year of the customer becoming aware of the damage and the liable party, and in any case within three years of the damaging event, except in the cases of section 14.1.

15. Confidentiality and references

15.1 Both parties will keep confidential the non-public information of the other party that they receive in connection with the contract.

15.2 We will only name the customer as a reference with its prior consent.

16. Intellectual property

The dpp24.org platform, its software, design and documentation remain our property or that of our licensors. The customer receives a non-exclusive, non-transferable right, limited to the term of the contract, to use the services for its own business purposes. Customer Content remains the property of the customer.

17. Data protection

We process personal data in accordance with our privacy policy. Where we process personal data on behalf of the customer, our data processing agreement applies.

18. Final provisions

18.1 These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

18.2 The exclusive place of jurisdiction for all disputes arising from or in connection with the contract is the court with subject-matter jurisdiction in Graz, Austria. We may also bring an action at the customer's registered office.

18.3 Declarations relating to the contract may be made in writing or by email.

18.4 The customer may only transfer the contract to a third party with our consent. We may use subcontractors and transfer the contract to a successor of our business, of which we will inform the customer in advance.

18.5 These Terms are written in English. If translations exist, the English version prevails.

18.6 If any provision of these Terms is or becomes invalid, the remaining provisions remain valid. The invalid provision will be replaced by a valid one that comes as close as possible to its economic purpose.
